CHAPTER I.

COMMON RULES

article 1

scope

1. This Regulation applies to the following types of aid:

i) Micro, small and medium-sized enterprises (SMEs) operating in the agricultural sector, i. H. are active in the primary production, processing or marketing of agricultural products, with the exception of Articles 14, 15, 16, 18, 23 and 25 to 28, which apply exclusively to SMEs active in primary agricultural production;

(ii) micro, small and medium-sized enterprises (SMEs) for activities not falling under Article 42 TFEU, provided that these aid are granted under Regulation (EU) No 1305/2013 and either from the European Agricultural Fund for Rural Development (EAFRD ) co-financed or provided as additional national funding to such co-financed actions;

b) aid for investments in the preservation of cultural and natural heritage on agricultural holdings;

(c) aid to remedy damage caused by natural disasters in the agricultural sector;

d) Aid for research and development in the agricultural and forestry sectors;

e) Aid to the forestry sector.

2. Member States may, if they deem it appropriate, decide to grant the aid referred to in paragraph 1 letters a, d and e under the conditions of and in accordance with Regulation (EU) No 651/2014.

3. This regulation does not apply to

(a) aid to the forestry sector which is neither co-financed by the EAFRD nor provided as additional national funding to such co-financed measures, with the exception of Articles 31, 38, 39 and 43;

(b) aid to SMEs for activities not covered by Article 42 TFEU, when such aid is neither co-financed by the EAFRD nor provided as additional national funding to such co-financed measures.

4. This regulation does not apply to

(a) aid schemes falling under Articles 17, 32 and 33, Article 34 (5) (a) to (c) and Articles 35, 40, 41 and 44, provided that the average annual budget exceeds EUR 150 million after six months after their entry into force. The Commission may decide that this Regulation will apply to such an aid scheme for a longer period after having approved the relevant evaluation plan notified to the Commission by the Member State within 20 working days of the entry into force of the scheme;

(b) changes to the rules referred to in paragraph 4 (a) of this Article other than changes which may not affect the compatibility of the aid scheme with this Regulation or have a material effect on the content of the approved evaluation plan;
