Invalid vote

Voices at the are invalid Bundestag electionwhen the ballot

  1. is not officially established,
  2. contains no marking,
  3. is valid for another constituency,
  4. does not show the will of the voter beyond doubt,
  5. contains an addition or reservation.

In the first two cases, both votes are invalid. In the third case, only the first vote is invalid if the ballot is valid for another constituency in the same country. The facts of Nos. 4 and 5 are discussed under “Invalid ballot papers”.

If the voting slip contains only one vote, the vote that has not been cast is invalid.

In the Postal vote In addition, both votes are invalid if the ballot has not been submitted in the official ballot envelope or in a ballot envelope which obviously differs from the others in a manner that endangers voting secrecy or contains a clearly tangible object, but which has not been rejected for these reasons.

Several ballot papers contained in a ballot envelope are considered to be one ballot paper if they have the same wording or if only one of them is labeled; otherwise they count as one ballot with two invalid votes.

If the ballot envelope has been submitted empty, both votes are considered invalid.

At European elections the same applies with the proviso that there are no constituencies here.
